Culpa means guilt or fault and is a Latin word but is found in Spanish as well. In terms of Law culpa means a negligence or fault. It can be interpreted as fault, blame and negligence.

Even though culpa is termed as a fault as per the law it is distinguished from deceit or fraud. Culpa only includes those categories of fault that were not caused intentionally. The Latin word Dolus is used when referring to fraud and deceit as intentional actions. Dolus is a defect of the Heart and Culpa one of the mind.

In law culpa is applied to cases involving acts of omission and commission in matters involving contracts and tort.

Various phrases exist where the word culpa is used; including mea culpa or my fault, Levis culpa or ordinary and common negligence, Levissima culpa is used in reference to a slight fault or neglect and Lata culpa meaning wanton or gross fault or negligence.
