A summons is a legal document issued by a court against a person advising him to appear in front of a court at a specific date and time as he is being sued and a case has been filed against him. A person against whom a summons is addressed is called defendant and he has to appear in court or respond in writing at specified date. A summons is also given a second name as Writ.

Summons is prepared by the attorney of the party who wants to file a claim against the defendant. This summons is given to the clerk of the court where the hearing for that case will be held. The clerk sign off the document and it is delivered to the defendant. Defendant has to respond to the summons within Twenty days or whatever time is allowed by the court.

Summonses can be sent in many cases e.g. for a charge of murder, for a divorce case, and for any public violation activity.

"Citation" or "Notice to Call" is another type of summons that is sent to the defendant by the legal official like by Magistrate of the city to appear in front of him for some minor crimes like Traffic Law violations, for breaking any public law – like smoking in a public place. Failure to respond to a summons is also considered a separate charge.

"Summon" means a call in an official matter, such as to attend court. Or we can say in simple words it means "to ask to come". A summon is a paper prepared by the petitioner and which is further issued by a court that informs the defendant that he has been sued (institute a legal trial against; to file a suit in opposition to). The "summons" needs that the defendant must file a response to the court. Or in many cases simply appear personally on prearranged day, in a given time period or danger losing the case under the conditions of a default judgement. A summon can be a judicial summon which is issued by a court or can be an administrative summon which is a legal paper issued by government administrative agency.

You would be obliged to go - there is no choice about obeying a summons. The exact legal term is "to serve (or be served) with a summons."

Summons according to Common Law based upon the Magna Charta means - 'Invitation' and 'Person' as specified on documents and in order to confirm your name in court means 'Fiction.' If you do not confirm your 'Person' in court and do not stand for the magistrate then the magistrate has no jurisdiction over you and thus no power.
